Guest Terms of Service

Effective Date: March 7, 2026

1. Charter Agreement

These Guest Terms govern your use of charter services booked through MyBoatOS. By completing your booking, you agree to these terms.

2. Your Responsibilities

  • Provide accurate information (name, contact info, party size, dietary restrictions) through the booking portal
  • Guests must arrive at the designated meeting location at the scheduled time
  • The maximum party size specified at booking is a hard limit enforced by USCG regulations for the vessel
  • Guests under 18 must be accompanied by a parent or legal guardian
  • Guests are responsible for the conduct of all members of their party

3. Safety and Captain's Authority

The captain of the vessel has final authority over all decisions affecting vessel and passenger safety. The captain may modify, shorten, or cancel a charter at any time due to weather, sea conditions, mechanical issues, or passenger safety concerns. No refund is owed for cancellations due to genuine safety concerns.

4. Cancellation and Refunds

Refund and cancellation terms are set by the charter operator and disclosed at booking. MyBoatOS is not responsible for operator refund decisions. If you believe a refund was improperly denied, contact us at support@myboatos.com.

5. Assumption of Risk

Boating activities carry inherent risks. By participating in a charter, you acknowledge and accept these risks. You represent that all members of your party are capable of participating safely.

6. Damage and Liability

Guests are responsible for any damage caused by themselves or their party to the vessel, equipment, or other guests. The charter operator may seek recovery of actual damages.

7. Personal Property

MyBoatOS and charter operators are not responsible for the loss, theft, or damage of personal property brought aboard.

8. Governing Law

These terms are governed by the laws of the State of Florida.
